Terms & Conditions

Effective Date: March 15, 2026

These Terms and Conditions ("Terms") govern the relationship between Equal Pixels ("Provider") and the client ("Client") for the setup, customization, and deployment of the Houzez Mobile application.

1. Payment & Financial Terms

  • Advance Payment: A non-refundable advance payment is required to initiate the project. Work will not commence until the deposit is cleared.

  • Extra Features: These Terms cover the standard Houzez Mobile feature set. Any customizations, custom API integrations, or additional features requested by the Client will be quoted and charged separately.

  • Third-Party Costs: The Client is responsible for all third-party costs, including but not limited to:

    • Push notification services (e.g., OneSignal, Firebase).

    • Google Maps API usage.

    • SMS Gateway or Email Marketing tools.

2. Technical Requirements & API

  • API Compatibility: If the Client is using a WordPress theme or stack other than the official Houzez Theme, the Client must provide a fully functional and documented Website API.

  • Account Access: The Client must provide valid Google Play Developer and Apple Developer account credentials. Delays in providing these accounts will result in a corresponding shift in the delivery timeline.

3. Deployment & App Store Approval

  • Approval Timeline: The Client acknowledges that the approval process for the Google Play Store and Apple App Store is governed by third parties. Approval can take up to 30 days or more.

  • Rejection Handling: Provider is responsible for fixing technical bugs if an app is rejected. However, if an app is rejected due to the Client’s content, business model, or Apple/Google policy changes, additional hours to modify the app will be billable.

4. Client Obligations & Data

  • Information Accuracy: The Client is responsible for the accuracy of all property data and content within the app.

  • Maintenance: Unless a separate maintenance retainer is signed, the Client is responsible for maintaining their WordPress site and hosting. Provider is not liable for app failures caused by Client-side changes to the website or API.

5. Legal Protections (Limitation of Liability)

  • Final Delivery: Once the app is submitted to the stores and credentials are handed over, the project is considered "Delivered."

  • No Guarantee of Leads: While the Provider sets up the n8n workflows for Meta Ads and WordPress, the Provider does not guarantee a specific volume of leads or sales.

  • Limitation of Liability: In no event shall Equal Pixels be liable for any indirect, incidental, or consequential damages (including loss of profits or real estate commissions) arising from the use or inability to use the application.

6. Intellectual Property

  • The Client is granted a license to use the Houzez Mobile app for their specific business. The underlying source code and proprietary logic developed by Equal Pixels remain the property of the Provider unless otherwise agreed in writing.
